Frequency Asked Questions

This page provides answers to frequently asked questions, the answers of which are derived from the two governing documents of Jackson Hills.  Jackson Hills properties are governed by the Architectural Guidelines and as well as the Jackson Hills Covenants And Restrictions.  Further, all residents must follow Happy Valley Municipal code.  For detailed information please refer to these two documents as well as City Code.

Homes and Property

Any change to a structures, topography, landscape or the look of the property from the street requires architectural approval.  This includes any buildings, fences, walls, driveways, and lawn.  For example, an Approval is required when removing and re-planting a lawn, even if the new lawn is intended to look substanciallyncuially like the existing.

Approval are highly encouraged before applying for a City permits.

The architectural committee will respond to applications within 10 – 20 working days.

Yes.  Architecture Approval neither waives the need for City, County, State, or Federal requirements nor permits.

Front facade must include a minimum of 25% of stone or brick.

  • Materials or inventories for a business are not allowed to be stored on any property within Jackson Hills.
  • Materials for homeowners projects or done on their own property do not requite approval.
  • Temporary modular storage for moving is allowed for up to one week.
  • Business advertisement of any time is prohibited.

All satellite dishes require architectural approval and screening landscape is required to maintain a pleasing exterior.  

  • All dishes must obscured from view from the street.
  • All ground mounted dishes must not be viewable from the street or adjacent property.
  • All dishes must be more than 30 feet from a street, and more that 6 feet from any property line, more that 10 feet from the front of the home.
  • Roof mounted dishes must be below the highest peak of the roof.

Windows air conditioners are allowed May 1st – October 1st and must not be visible from the street.

Earth tone colors fitting with the neighborhood are likely to gain architectural approval.  Vibrant or contrasting colors will not be approved.

Please submit sample paint chips or HEX color codes with your Architectural Approval request.

All new or replacement fences require approval before construction can begin.

  • All fences must be at least 36 inches from a sidewalk.  Evergreen landscaping is required between the sidewalk and fence.
  • Fences must be between four and six feet tall depending on location.
  •  Fences adjacent to another fence should match material and construction.
  •  
  • Only above ground pools are permitted.
  • Hot tubs may be above ground.  Structures must match the home and be complimentary to the neighborhood.
  • Pools and hot tubs must be properly screened from view from the street or adjacent lots by minimum 6 foot plantings.

Any play equipment visible from the street or adjacent lot requires approval.

Any basketball hoop, goals, etc require architectural approval.

Homeowners are responsible for maintaining sidewalks and planting strips along their property.  The City of Happy Valley municipal code defines the specific deflection that constitutes a sidewalk a hazard and must be repaired.

It is recommended to remove the source of the lift or crack prior to replacing, lifting, or grinding sidewalks for the best, lasting result.

Flat, roof mounted solar collectors are allowed.  Wind turbines are not allowed.

Plumbing, electrical, and connections must be run within the walls or encased in a chase constructed of a material and color matching the home.

All roof mounts and materials must be painted the same color as the roof. 

 

Landscape

  • Turf is not allowed when visible from a street or adjacent lot.
  • City of Happy Valley city code requires planting strips to be planted with live vegetation. 
  • Turf placed without approval is subject to lien and must be brought into accordance with community standards..

Trees within planting strips are the responsibility of Jackson Hills homeowners. 

  • Trees do have a limited lifespan and should be replaced when they pose a danger to structures or sidewalks.
  • Approved trees for planting in planting strips can be found in Happy Valley City code 16.50.110.
  • Trees in planting strips have specific spacing defined by the City of Happy Valley.  They should be placed less than 30 feet apart, spaced evenly between the sidewalk and curb.  Spacing is 10 feet from a utility pole, 5 feet from a driveway, and 2 feet from a property line.
  • Further, Happy Valley City Code 8.08.290
    requires trees to be trimmed to 11 feet above a sidewalk, 14 feet above a street.

Tree removal on a homeowners property require specific considerations.

  • Happy Valley City Code 8.08.29 requires trees to be trimmed to 7 feet above a sidewalk, 11 feet above a street. 
  • Cutting trees with a trunk diameter greater than three inches or more require Jackson Hills HOA Architectural Approval.
  • Cutting trees with a trunk diameter greater than six inches requires City of Happy Valley approval

Homeowners are responsible for maintaining all parts of their property including planting strips and sidewalks. 

White real estate ‘For Sale’ signs are allowed.

Wire signs are prohibited except for temporary ‘open house’ signs, which must be removed within 24 hours.

Political signs are allowed, but must be removed 10 days after the election.

Business signage is not allowed.

Screening landscape is used to hide sections of or beautify a property.  An example of screening landscape would be a dense, evergreen shrub six feet or taller that cannot be seen through at any time of the year. 

Landscape vegetation (Hedges, bushes, etc.) be trimmed below the bottom of the first floor windows.

Landscape vegetation (Hedges, bushes, etc.) must be trimmed to allow three feet of horizontal clearance between the edge of the pavement and the vegetation. 

Any tree touching a home or within one foot of a property line must be trimmed.

Trees do have a limited lifespan and should be replaced when they pose a danger to structures or sidewalks.

Any vegetation growing over a sidewalk, walkway, or driveway anywhere on the property must be trimmed.   Further, Happy Valley City Code 8.08.290
requires trees to be trimmed to 11 feet above a sidewalk, 14 feet above a street. 

Pets

Jackson Hills residents are allowed three domestic pets.  This means dogs, cats household pets or domestic animals including rodents, snakes, and rabbits.  Domestic animals are defined in Happy Valley Code, Title 6, Section 6.04.030(M)

Any animal considered dangerous or a nuisance is not allowed in Jackson Hills.

Any animal that threatens, intimidates, or is an unreasonable danger to life or property.  Additionally, any and animal that attacks or bites a person or animal more than one time.

Jackson Hills residents are required to report any incident to Happy Valley Municipal officers and the Homeowners Association within one business day.

A nuisance pet is considered:

  • Any animal that creates more than 50db of noise when measure from inside a neighboring home.
  • Any animal that creates an odor noticeable from adjoining property.
  • Any property that becomes unsightly, such a dead landscaping, holes, etc.
  • Any pet considered dangerous.

In accordance with Happy Valley Municipal Code, no chickens are allowed on residential properly if used, sold, or products sold commercially. 

Animals must be properly penned at all times, pens must be visually appealing, proper sanitation maintained, and all pens and related items such as food be stored in a rodent proof manner at least five feet from any properly lines.

Pens will be obscured from view from adjacent lots with a fence, wall, or hedge which is a minimum of 6 feet high.

Vehicles

Jackson Hills residents are required to notify the HOA of their vehicles or that of their tenants.  The following Information is required.

  • Make & Model
  • Year
  • License Plate
  • State Registered

 

 

Yes. Vehicles should be repaired out of public view, such as inside a garage.

Inoperable vehicles are not allowed in public view from the street or adjacent lots.

Any vehicle in public view must be re-parked every 72 hours, meaning the vehicle needs to move at least the distance of one parknig space.

Parking of recreational vehicles and boats is allowed within a homeowners garage.  

Temporary parking of RVs and boats on the street or where otherwise visible from the street or adjacent lots requires HOA approval.

Vehicles are not allowed that can be heard within an adjacent home at more that 50 decibels.

Any vehicle being operated unsafely should be reported to happy valley police immediately.
